This website, thehampercogeraldton.com.au, is operated by THCG Trust trading as The Hamper Co Geraldton ("The Hamper Co", "we", "us" or "our"). By visiting our website or purchasing from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy and Shipping Policy.

Please read these Terms carefully. If you don't agree with them, please don't use the website. We may update these Terms from time to time by posting the changes on this page, and continuing to use the website means you accept the updated Terms.

Our store is hosted on Shopify, which provides the online store platform we use to sell our products to you.

Your rights under Australian Consumer Law

Nothing in these Terms excludes, restricts or changes any rights you have under the Australian Consumer Law or any other law that can't be excluded. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Where these Terms limit our liability, they only do so to the extent the law allows.

Section 1: Using our online store

By agreeing to these Terms, you confirm that you're at least 18 years old, or that you have the consent of a parent or guardian to use this website.

You must not use our website or products for any illegal or unauthorised purpose, or in a way that breaches any law, and you must not attempt to upload viruses or harmful code.

Section 2: Alcohol

Some of our hampers contain alcohol. Alcohol is sold only as part of our hampers, in line with the Liquor Control Act 1988 (WA). By purchasing a hamper that contains alcohol, you confirm that you are 18 or over and that the person receiving it is 18 or over. It's an offence to supply or obtain liquor on behalf of a person under 18. We may refuse to supply or deliver alcohol if we're not satisfied these requirements are met.

Section 3: General conditions

We may refuse service to anyone for any lawful reason. Card details are always encrypted during transfer. You agree not to copy, reproduce or resell any part of our website or its content without our written permission.

Section 4: Accuracy of information

We do our best to keep the information on our website accurate and up to date, but it's provided for general information only, and occasionally it may be incomplete or out of date.

Section 5: Changes to products and prices

Prices and products may change without notice. We may modify or discontinue any product or part of the website at any time.

Section 6: Products

We make every effort to show our products accurately, but colours may vary depending on your screen. Hampers are made to order, and if an item is unavailable we may substitute it with the closest available item of similar or greater value.

We may limit quantities of any product, and may refuse or cancel an order where required (for example, if a product is out of stock or there's a pricing error). If we cancel an order after payment, we'll refund you in full.

Returns and cancellations are covered by our Refund Policy, and delivery and pickup details by our Shipping Policy.

Section 7: Your order and billing information

You agree to provide current, complete and accurate details for your order, including correct delivery and recipient details. We aren't responsible for delays or failed deliveries caused by incorrect or incomplete details provided at checkout.

Section 8: Third-party tools and links

Our website may include third-party tools or links to other websites (for example, social media). We don't control these and aren't responsible for their content or practices. Please review their terms before using them.

Section 9: Comments, feedback and reviews

If you send us comments, reviews or suggestions, you agree we may use, edit and publish them. You agree your comments won't be unlawful, abusive, misleading or infringe anyone's rights. We may remove any content we consider inappropriate.

Occasionally our website may contain errors in product descriptions, pricing, promotions, delivery charges or availability. We may correct errors and update information at any time, and, where permitted by law, cancel orders affected by an error. If we do, we'll refund you in full.

You must not use our website to break the law, infringe anyone's rights, submit false information, upload harmful code, collect other people's personal information, spam, scrape or interfere with the website's security.

Section 13: Limitation of liability

Subject to your rights under the Australian Consumer Law, we don't guarantee that the website will always be available, uninterrupted or error-free. To the extent permitted by law, we aren't liable for any indirect or consequential loss arising from your use of the website. Where our liability can't be excluded but can be limited, our liability is limited (at our choice) to replacing or re-supplying the goods, or refunding the price paid.

You agree to compensate us for any claim or reasonable legal costs arising from your breach of these Terms or your breach of any law, to the extent permitted by law.

Section 15: Severability

If any part of these Terms is found to be unenforceable, the rest of the Terms will still apply.

We may suspend or end your access to the website if you breach these Terms. Any obligations incurred before then continue to apply.

Section 17: Entire agreement

These Terms, together with our policies, make up the whole agreement between you and us about your use of the website.

Section 18: Governing law

These Terms are governed by the laws of Western Australia, and you and we submit to the courts of Western Australia.
